Though the immediate care facility - now tending to 37 patients - will be closing its doors, the larger skilled nursing facility is planning to stay open, the Associated Press reports.

The company announced the closure in a statement on February 7.

The case came to light in December when the unidentified patient, a woman in her 20s, went into labor.

A frantic 911 call captured the scene, with a nurse at one point yelling, "The baby's turning blue!"

In the documents, it said the woman "lacks sufficient understanding and mental capacity to make decisions or give consents for her medical, placement or financial estate" and suffers from quadriplegia, recurrent pneumonia and a seizure disorder.

A nurse was charged with sexual assault after an incapacitated patient gave birth.

Officials with Hacienda HealthCare said its board of directors determined it's not sustainable to keep operating its intermediate care facility in Phoenix. "Thus, we will begin to transition clients and eventually cease operation", the facility said in a letter to its employees Thursday.

"Your recent correspondence and statements to the media make it clear that rather than complying with the prior agreement to bring in a third party and without a definite plan to address challenges Hacienda faced with the third party it chose, such as costs, the Board of Directors made a decision to close the facility citing the facility's lack of financial viability", the letter said. His executive order will require employees at state-funded care facilities to undergo annual training in recognizing and preventing abuse and neglect.

About a week later, a former prosecutor was hired to investigate how the patient was sexually assaulted separate from a police investigation.

The baby, a boy who is being cared for by family members, is doing well, police have said. "Hacienda intends to do everything possible to restore its credibility in the eyes of our patients, families, the community and our agency partners at every level", Hacienda said in a statement. Sutherland, 36, was a licensed nurse who had worked at the facility since 2011.

Sutherland, who was shackled and carrying a legal pad during the arraignment hearing, pleaded not guilty to charges of sexual abuse and abuse of a vulnerable adult.

It would take weeks or months to transition all of them to other places. The care provider will have to work with an outside health care consultant until the state finds it is in compliance.

The state had ordered Hacienda to hire a third-party management team to oversee daily operations, but Hacienda and the outside party weren't able to reach a long-term agreement, NBC News/AP reported.
